Stevenson v. Swiggett, 101, 2010

In defendants' appeal from the Superior Court's order denying their motion to vacate a default judgment, the order is affirmed where: 1) because the Superior Court properly had in personam jurisdiction, the default judgment entered against the defendants was not void; and 2) defendants failed to meet their burden of establishing mistake, inadvertence, surprise, or excusable neglect under Rule 60(b)(1), and denied their motion.
