Supreme Court of Delaware
Thompson v. Lynch, 429, 2009
In an action to partition a parcel of land, the chancery court's partition order is affirmed where: 1) the chancery court correctly held that appellants were judicially estopped from contradicting their previous position that the court had jurisdiction to hear the matter; and 2) the record supported the special master's factual findings.
