Brown v. United Water Del. Inc., 291, 2009

In an action alleging negligence by a public utility, summary judgment for defendant is vacated where the filed rate doctrine could restrict or eliminate liability for a public utility's ordinary negligence, but did not necessarily apply in cases of gross negligence or willful misconduct.
