A conviction for Home Improvement Fraud is affirmed in part where defendant was properly charged and the jury was properly instructed on the essential elements of Home Improvement Fraud. However, the matter is remanded for resentencing on a single count of Home Improvement Fraud the three counts were legally merged into one.
