Supreme Court of Delaware
Sanabria v. Delaware, 319, 2008
Conviction for burglary in the second degree is reversed where the superior court abused its discretion in allowing a police officer to testify about third party statements made by a dispatcher, as the testimony was unfairly prejudicial and violated plaintiff's Sixth Amendment rights under the Confrontation Clause in permitting the police officer to testify about the dispatcher's statements without a limiting instruction that the dispatcher's comments were not being admitted for the truth of their content.
