Tony Ashburn & Son, Inc. v. Kent County Reg'l Planning Comm'n, 68, 2008

In an appeal of a decision of a county regional planning commission denying a subdivision application, judgment affirming the decision is reversed where: 1) the commission lacked the power to deny a legally conforming subdivision plan; and 2) subsequent amendments to the county code were not retroactively applicable to petitioner's proposal.
