Foster v. Delaware, 592, 2007

Conviction for burglary and robbery is affirmed where: 1) a prosecutor's reference in his opening statement to the television show "CSI" was improper but did not violate defendant's due process rights; 2) testimony of the sister of the complaining witness was properly admitted under the excited-utterance hearsay exception; and 3) defendant waived his argument that the state failed to establish the predicate foundation for admission of a statement.
