Supreme Court of Delaware
Manna v. State of Delaware, 272, 2007
Conviction for robbery, wearing a disguise during commission of felony, and conspiracy is reversed and remanded where: 1) the Superior Court erred as a matter of law in applying D.R.E. 608 to determine the admissibility of the character evidence offered by the accused for the purpose of proving the defendant acted in conformity with his character; and 2) although reasonable limits may be placed upon the number of character witnesses, the Superior Court's exclusion of all character evidence in this case under D.R.E. 403 was an abuse of discretion.
