Supreme Court of Delaware
Scarborough v. State of Delaware, 328, 2006
In a case involving a plea agreement and an agreement to work undercover in exchange for sentencing leniency where the arrangement has subsequently gone haywire, the lower court's judgment is vacated and remanded in part where: 1) the State, in contrast to its implied duty to act in good faith, unreasonably rejected the "work" that the accused proposed; and 2) the more appropriate remedy is to enforce the State's promise to withhold petitioning for habitual offender status.
