Supreme Court of Delaware
Manley v. State of Delaware, 75-2006, 82-2006
Defendants' death sentences ordered after a penalty hearing for the murder of a witness to be called against defendant in a criminal trial is affirmed over claims that: 1) the trial court committed an error of law by instructing the jury on accomplice liability at the penalty phase of the proceedings; 2) defendants were not eligible to be sentenced to death under the Enmund/Tison decisions of the U.S. Supreme Court; and 3) there was insufficient evidence to support a jury's finding as to two statutory aggravators.
