Rawley v. J.J. White, Inc., 312, 2006

Dismissal of an injured worker's complaint for liquidated damages and attorneys fees pursuant to 19 Del. C. 2357 arising from a disagreement with his employer on charges for certain medical services is affirmed where dismissal of the complaint as untimely was proper since his remedy available before the Industrial Accident Board was not exhausted.
