Pierce v. State of Delaware, 56, 2006

A conviction for rape and attempted rape is affirmed over claims that: 1) the incident leading to his conviction should be viewed as a single, ongoing incident rather than four separate and distinct assaults because his acts took no longer than 15 minutes to complete; and 2) the superior court erred by refusing to give a specific jury instruction regarding single theory unanimity.
