Supreme Court of Delaware
Hassan-El v. State of Delaware, 472, 2005
A conviction and sentence for felony murder and additional offenses are affirmed over claims that: 1) his conviction for felony murder should be vacated because the homicide was not "in furtherance of" the underlying felony of attempted robbery; 2) the trial judge committed legal error when he instructed the jury regarding felony murder; and 3) the trial judge should not have allowed in as evidence an out-of-court police interrogation of the state's main witness, because the statement included the officers' opinion as to whether he was telling the truth.
