Supreme Court of Delaware
Lank v. Moyed, 251, 2006
In a wrongful death and survivorship action arising from an automobile accident, summary judgment for defendant is affirmed over claims that the superior court erred in: 1) holding that defendant's policy of insurance provided single limits coverage encompassing plaintiff's claims for both wrongful death and for survivorship; 2) finding that the applicable policy language was unambiguous; and 3) holding that a single limits policy provision was compatible with public policy.
