Supreme Court of Delaware

Drummond v. State of Delaware, 81, 2006

Conviction for trafficking and possession is affirmed as appellant's allegations of racial profiling are without merit where, as to discriminatory effect, police report stating desire to purchase drugs from "a black male source of supply" does not indicate discriminatory effect as the report merely memorialized past events and, as to discriminatory purpose, there was no threshold showing of different treatment of similarly situated persons of other races.
