Supreme Court of Delaware

Burkett-Wood v. Haines, 630, 2005

In a negligence action arising out of an auto accident, judgment is affirmed where: 1) motion for a directed verdict was denied as internal inconsistencies in testimony prevented plaintiff from conclusively establishing causation; and 2) motion for new trial was denied as, based on the overall evidence presented at trial, a reasonable juror could find the injuries did not result from the accident.
