Butler v. Newark Country Club, 420, 2005
In a wrongful death action arising from the accidental drowning of a child in an irrigation pond, summary judgment for country club, the owner of the pond, is affirmed where it owed no duty to protect the child from falling through the ice on its pond because the pond was not an artificial condition within the meaning of the attractive nuisance doctrine, and because it was a danger that children should reasonably understand.
