Burkett-Wood v. Haines, 630, 2005

A judgment adverse to plaintiff in a negligence action arising from a car accident is affirmed where: 1) a reasonable juror could find that a medical expert's testimony created a genuine issue of material fact about whether defendant's negligence caused plaintiff's injuries; and 2) based on the overall evidence presented at trial, a reasonable juror could find that plaintiff's injuries did not result from the accident.
