In a coverage dispute by insurers in a personal injury action, summary judgment for plaintiff is affirmed where defendant waived it's insured's right to a defense from plaintiff by failing to conduct a pre-trial inquiry into the insured-s potential coverage under plaintiff's policy and by seizing the defense of the insured.
