Supreme Court of Delaware
CAIN v. GREEN TWEED & CO., INC., 124, 2003
The Superior Court erred 1) in ruling that an affidavit plaintiff filed in opposition to defendant's summary judgment motion was a sham and would not be considered, and in 2) concluding that the record did not establish a "product nexus" for an inference that plaintiff had been exposed to an asbestos-containing product.
