WARRINGTON v. STATE OF DELAWARE, 72/74, 2002
Under the self-defense within a dwelling defense, defendant's reasonable belief that an intruder will injure someone in the dwelling must exist at the time defendant acts in self-defense, thus where an intruder was subdued a jury could properly find that a killing was not justified as an act of self-defense.
