Supreme Court of Delaware
HAMILTON v. STATE OF DELAWARE, 268/293/302-2001
A finding that defendants lacked the requisite state of mind to support a Murder Second Degree conviction also precludes a Manslaughter conviction. A finding that one defendant warned other defendants of a victim's pregnancy precludes the warning defendant's conviction of any degree of an offense involving the fetus.
