CHAVIN v. PNC BANK, DELAWARE, 175, 2002
In a dispute over the word "then" as used in a trust provision, in order to give effect to the settlor's intent the trust must be construed as meaning that the settlor's son had to be alive at the time of distribution in order to take under the trust.
