BRADSHAW v. STATE OF DELAWARE, 345, 2001
Defendant's absence from the courtroom both 1) at the time his counsel agreed to a charge to a deadlocked jury under Allen v. U.S., 14 U.S, 492, and 2) when the charge was given, violated his right to be present "at every stage of the trial"; counsel had no authority to waive that right, and resulting error was prejudicial.
