DeJesus v. Richards Paving, Inc., 05C-04-093

Plaintiff's motion for summary judgment, in a case arising from his work-related injuries when he was pinned between a rolling machine and a guard rail, is denied where genuine issues of material fact remained as to issues, including: 1) the sequence of events of a demand for payment and partial payment; 2) whether sufficient notice was provided to plaintiff of a dispute as to the reasonableness of medical bills; 3) whether plaintiff was on notice of challenges to reasonableness within a particular time frame; and 4) whether a carrier had a reasonable, good faith basis to believe that a payment satisfied its obligation.
