Nationwide Gen. Ins. Co. v. Hertz Corp., 05C-12-008
A cause of action for a PIP insurer's right of subrogation, against the tortfeasor's liability insurer, accrues upon the last PIP payment. In a subrogation action wherein plaintiff-insurer made personal injury protection payments to its insured and sought reimbursement from defendant, tortfeasor's insurer, defendant's motion for summary judgment is denied where plaintiff's three year statute of limitations began to run upon his final PIP payment, not his first.
