Commonwealth Constr. Co. v. Cornerstone Fellowship Baptist Church, Inc., 04L-10-101
Following a non-jury trial arising from a mechanic's lien and breach of contract complaint filed by plaintiff-general contractor, the court finds in favor of plaintiff on its claims where plaintiff adequately pled its right to a lien, and defendant-church materially breached the contract at issue by failing to submit claims to an architect, which was a condition precedent under the contract. Further, defendant failed to prove either breach of contract or fraud.
