Aurigemma, M.D. v. New Castle Care LLC, 05C-04-113

A contract for exactly one year, entered into before the date it is set to commence, is within the Statute of Frauds and is unenforceable unless evidenced in writing. In an action brought by a doctor against a medical facility for breach of an alleged oral agreement under in which the doctor was to serve as medical director of the facility, summary judgment for defendant is granted where the alleged contract fell under the Statute of Frauds, and the partial performance doctrine did not apply.
