Superior Court of Delaware

Willey v. Willey, 05C-06-009

In a loan dispute between plaintiff-stepmother and defendants, her stepson and an oil company of which he was president, defendants' motion for summary judgment is denied where a material question of fact remained as to whether money given by the stepmother to stepson was a loan or gift, and there was also a fact question as to where funds for loans to the company originated.
