In a negligent supervision and 42 U.S.C. section 1983 case arising from injuries plaintiff sustained while she was in custody, defendants' motion to dismiss for failure to state a claim is granted where: 1) plaintiff could not maintain a claim against a police department for negligent failure to supervise patrolmen; and 2) defendants were not liable for violating plaintiff-s civil rights.
