In a case involving claims brought by foreign governments seeking recovery of medical expenses allegedly incurred in treating citizens' health problems caused by defendants' tobacco products, defendants' motion to dismiss for failure to state a claim is granted where: 1) Delaware law controlled all of plaintiffs' claims; and 2) plaintiffs' claims failed because they could not, as a matter of law, establish proximate cause.
