Handloff v. City Council of City of Newark, 05A-07-003
A petition for certiorari review of a decision of a city council denying an application for a subdivision and a parking waiver for a proposed apartment development is denied where the decision at issue was not manifestly contrary to law as: 1) the city council considered relevant factors when it requested a reduction in the size of the project; and 2) the council did not exceed its powers in denying the parking waiver or in conditioning approval of the project on petitioners' willingness to deed their land to the city.
