Superior Court of Delaware

Millius v. Tillman, 05C-09-107

A vocational expert is an "examiner" as the term is used in Superior Court Civil Rule 35. In a dispute arising from injuries allegedly sustained by plaintiff in a motor vehicle collision, defendants' motion to compel a vocational examination of plaintiff is granted pursuant to a finding that "good cause" was present under circumstances where one party retained a vocational expert and put their ability for future work at issue.
