Defendant's motion for a judgment notwithstanding the verdict is granted in a suit alleging negligence and breach of the implied warranty of merchantability arising from plaintiff's fall from a bicycle purchased from defendant, Toys "R" Us, where, once a jury determined that defendant was not negligent in assembling a bicycle, there was no rational basis for a finding that an alleged defect existed at the time of sale.
