In a case arising from a hit and run collision, the court finds that plaintiff's uninsured/underinsured motorist carrier was obligated to pay damages, and not defendant's liability carrier, where defendant rebutted the presumption that the driver of defendant's vehicle had defendant's express or implied consent to operate the vehicle on the day of the accident, and the driver was uninsured and in the country illegally.
