Ferguson v. Town of Dewey Beach, 04C-08-004
In a 42 U.S.C section 1983 and tort case arising out of injuries plaintiff sustained during his arrest: 1) plaintiff's motion for partial summary judgment is denied; 2) defendants' motion for summary judgment is granted in part as to malicious prosecution and false arrest claims; and 3) summary judgment is granted for specific defendants as to a gross and wanton negligence claim.
