Court of Chancery of Delaware

W.L. Gore & Assocs., Inc. v. Wu, 263-N

In a case brought by a former employer against defendant, one of its former scientists who eventually admitted to breaching contractual non-compete and confidentiality obligations owed to the company and to various other allegations including misappropriation of trade secrets, the court grants additional injunctive relief against defendant in light of the egregiousness of his misconduct, the overwhelming evidence that he cannot be trusted to police himself, evidence that he took electronic files from plaintiff and has not accounted to the court-s satisfaction as to the whereabouts of such files, and the ongoing harm that he can cause plaintiff if he continues to work in the same areas he worked before.
