Court of Chancery of Delaware
Citrin v. Int'l Airport Ctrs. LLC, 2005-N
In an action seeking a judicial order requiring defendants to honor their duty to advance plaintiff his legal expenses under the terms of their operating agreements, the court grants plaintiff pre-judgment interest on expenses he incurred for a particular period where defendants could not rely on plaintiff's failure to specify the amount of reimbursement he sought as a defense to prejudgment interest, because their own actions prevented him from doing so.
