Benge v. Oak Grove Motor Court, Inc., 1837-N

In a suit brought by a former husband against his ex-wife and others asserting causes of action relating to the division of marital property upon the couple's divorce, plaintiff's motion to transfer his case to the Family Court is granted where, although plaintiff did not follow the proper procedures to seek interlocutory review of what is ordinarily a non-appealable order, the state supreme court accepted his appeal and ruled on its merits, and thus, he had 60 days from its mandate to transfer the case.
