Court of Chancery of Delaware

Wilcox & Fetzer, Ltd. v. Corbett & Wilcox, 2037-N

In an underlying dispute between court reporting services companies involving the use of trade names and alleged improper advertising behavior, defendant's motion to compel arbitration of a common law trade name claim is granted where: 1) the arbitration clause at issue was broad; 2) the claim was within the scope of the clause; and 3) defendant, a nonsignatory to the agreement, could compel arbitration of the signatory-plaintiff under an equitable estoppel theory.
