In a suit seeking monetary and injunctive relief in connection with allegations of water damage to plaintiff's property from a neighboring retaining wall, a motion for reargument on a denial of third party defendant-state's motion to dismiss a county's complaint against it is denied over claims of error regarding: 1) the applicability of Article VIII, section 3 of the Delaware Constitution to loans; 2) Article VIII, section 6 and the county's indemnification claim; 3) ripeness; 4) contribution. A motion to sever and transfer is also denied.
