In a suit involving a litigation support company's claims of misappropriation of trade secrets and conversion, defendant's motion for summary judgment on his counterclaim against third party-defendants individually for wages earned and business expenses disbursed on plaintiff's behalf is denied where: 1) the law of the case doctrine provided no basis for precluding third-party defendants from defending the counterclaims at issue; 2) collateral estoppel did not apply; and 3) there were disputed issues of material fact as to whether the third party defendants were personally liable to defendant on a wage claim as plaintiff's officers or managing agents.
