Defendant's motion to preclude arbitration of certain claims is granted in part as to certain counts relating to an alleged breach of a Confidentiality Provision in an agreement, which were not subject to arbitration and, even if they were, plaintiff waived its right to arbitrate those claims. In a case relating generally to the same underlying transactions, the action is stayed so that an arbitrator can decide whether petitioner's claim for appointment of a receiver is subject to arbitration.
