O'Neill v. Town of Middletown, 2197-N
In a challenge to a town's rezoning, summary judgment is granted invalidating the rezoning where: 1) town council members' articulated reasons for voting in favor of the measures were legally insufficient to provide a basis for judicial review or were insufficient to support a rezoning; and 2) the court could not find unarticulated and clear reasons in the record to sustain the rezoning.
