In an action for specific performance of an alleged covenant to fix a water problem in the basement of plaintiff's townhouse or rescission of a contract for the sale of the townhouse, judgment is entered for defendants where plaintiff failed: 1) to prove that she was entitled to specific performance; 2) to satisfy her burden of proof with respect to her claims for damages; 3) to satisfy her burden of proof with respect to the rescission claim; and 4) to establish entitlement to damages for mental anguish or attorneys' fees.
