Quereguan v. New Castle County, 20298-NC

A motion to dismiss a third party complaint asserted by a county seeking to hold the state liable for harm attributable to water damage to plaintiff's home and property is denied over claims that the complaint was barred by sovereign immunity, a lease agreement between the county and state, res judicata, and laches. Further, the Uniform Contribution Among Tort-Feasors Law (UCATL), a lease, and the state constitution do not bar contribution or indemnity from the state.
