Supreme Court of California

People v. Colbert, 238954

Held that if a person enters a store during regular business hours but then proceeds to a private back office with intent to steal from there, the crime is burglary, not shoplifting. The case required the California high court to interpret a 2014 voter initiative, Proposition 47, that created a new misdemeanor offense called "shoplifting."
