City of Morgan Hill v. Bushey, 243042

Remanded for further proceedings to address whether a citizens group could put a referendum on a local ballot to challenge a zoning ordinance amendment. A citizens group that opposed the building of a hotel collected enough signatures to petition for a referendum related to the zoning ordinance. The city countered that the referendum would be unlawful for technical reasons relating to zoning law. The trial court ordered the referendum removed from the ballot, but the court of appeal reversed. The California Supreme Court vacated the court of appeal's decision and remanded for further proceedings.
