Connor v. First Student, Inc., 229428

Held that bus drivers could proceed with their suit alleging that they were not adequately notified of background checks conducted on them. The defendant employer argued that California's Investigative Consumer Reporting Agencies Act is unconstitutionally vague as applied to employer background checks due to its overlap with the state's Consumer Credit Reporting Agencies Act. Granting review to resolve a conflict in the courts of appeal, the California Supreme Court rejected the employer's argument. The panel held that the employer was not entitled to summary judgment, affirming the court of appeal, which had reversed the trial court.
