Ramirez v. City of Gardena, 244549

Affirmed summary judgment in favor of a city that was sued for wrongful death when its police officers pursued a vehicle and caused it to crash. California Vehicle Code section 17004.7 provides public agencies immunity from liability for collisions resulting from police chases if the agencies implement certain policies regarding vehicular pursuits. Here, a crash victim's mother argued that the city lacked immunity because some police officers had not certified in writing that they had read and understood the vehicle pursuit policy. Disagreeing, the California Supreme Court held that 100-percent compliance with the certification requirement is not a prerequisite to receiving the immunity.
